Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Propanalyzer ("Propanalyzer," "we," "us," or "our") governing your access to and use of the Propanalyzer platform, website, and all related features, tools, and services (collectively, the "Platform").

By clicking "Sign Up," creating an account, purchasing credits, or otherwise accessing or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

🚫 If you do not agree to these Terms, do not use the Platform.

Continued use of the Platform following any update to these Terms constitutes acceptance of the revised Terms.

Eligibility

You may use Propanalyzer only if you meet all of the following requirements at the time of registration and throughout your use of the Platform:

✓You are a human individual — not a bot, automated system, or entity registering without human direction.
✓You are at least 18 years of age, OR you are between 13 and 17 years old and a parent or legal guardian has reviewed these Terms and provided verifiable consent on your behalf before account creation.
✓You are not legally prohibited from accessing or using the Platform under any applicable local, state, or federal laws.
✓You have not previously had a Propanalyzer account terminated for a violation of these Terms.

🚫 Children under 13 are not permitted

The Platform is not directed to children under 13 years of age and we do not knowingly collect data from them. If we discover a user under 13 has registered without verifiable parental consent, we will immediately close the account and delete all associated data.

Account Registration & Security

3.1 — One Account Per Person

Each Propanalyzer account must correspond to a single, individual human user. Sharing credentials or creating multiple accounts is strictly prohibited and may result in suspension.

3.2 — Account Accuracy

You agree to provide accurate, current, and complete information. Providing false, misleading, or fraudulent information is grounds for immediate account termination without refund.

3.3 — Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and all activities under your account. You agree to:

Use a strong, unique password that is not used on other services.
Never share your password or login credentials with any other person.
Log out of shared or public devices after each session.
Notify us immediately at support@propanalyzer.com if you suspect unauthorized access.

3.4 — Account Deletion

You may delete your account at any time from within your account settings. Deletion requires password confirmation and is permanent and irreversible. All unused credits are forfeited and all personal data will be purged within 30–90 days. Please download any reports you wish to keep before initiating deletion.

What the Platform Does

4.1 — Core Functionality

Propanalyzer is an AI-powered time-saving tool for real estate investors. Through a conversational AI chat interface, the Platform automates gathering property data, running comparable sales, and calculating key financial metrics:

→Collecting and organizing property details
→Pulling and comparing nearby property sales (comps)
→Calculating ARV, repair costs, ROI, cash-on-cash, cash flow, DSCR
→Generating downloadable PDF investment analysis reports
→Evaluating deals: Fix & Flip, Rental, BRRRR, Wholesale

4.2 — Output Accuracy Depends on Your Inputs

The quality and accuracy of any analysis output is directly dependent on the accuracy and completeness of the data you provide. Propanalyzer does not independently verify property data you submit.

Once you initiate an analysis and the AI begins processing, the associated credit is consumed. The analysis cannot be cancelled, reversed, or refunded — even if you entered incorrect information.

4.3 — Platform Availability

We strive to maintain continuous availability but do not guarantee uninterrupted service. Scheduled or unscheduled maintenance may cause temporary interruptions. We will make commercially reasonable efforts to provide advance notice.

4.4 — Platform Changes

We reserve the right to modify, update, add, or remove features at any time. We may change credit pricing or analysis structure with advance notice to registered users.

Nothing on the Platform — including AI-generated analysis reports, calculated financial metrics, investment strategy recommendations, property valuations, or any other output — constitutes or should be interpreted as financial advice, investment advice, legal advice, or any other form of professional advice.

Propanalyzer is a productivity and data-processing tool whose purpose is to help you collect and organize property investment data and run financial calculations faster than doing so manually. It is not a substitute for professional due diligence, licensed expertise, or independent verification.

You specifically acknowledge and agree that:

All analysis outputs reflect only the data you enter and are limited by its accuracy.
Real estate markets are dynamic and unpredictable; no AI can reliably forecast outcomes.
Propanalyzer does not independently verify property data, repair estimates, or comps.
The platform may produce incomplete, inaccurate, or unsuitable outputs for your situation.

Before making any real estate investment decision, you should independently:

Conduct thorough personal due diligence on the property and market
Consult a licensed real estate professional, financial advisor, CPA, or attorney
Independently verify all property data, comps, repair costs, and projections
Assess suitability for your financial situation and risk tolerance

Propanalyzer is not a registered investment advisor, broker-dealer, financial planner, real estate agent, or licensed professional of any kind. Your use of this Platform does not create any professional, advisory, fiduciary, or client relationship between you and Propanalyzer.

Credits, Payments & Refunds

6.1 — Credit System

Access to property analyses requires credits, purchased in advance:

$1.00= 1 credit = 1 analysis

Credits are deducted at the moment an analysis is initiated. Pricing may change with advance notice.

6.2 — Payment Processing

All credit purchases are processed securely through PayPal. Propanalyzer does not store, handle, or have access to your full PayPal credentials or credit card numbers. All payment data is managed within PayPal's PCI-compliant infrastructure.

6.3 — Refund Policy

6.4 — How to Request a Refund

Email support@propanalyzer.com with subject line "Credit Refund Request". Include your account email and purchase date. We will respond within 5 business days.

6.5 — Credits Are Non-Transferable

Credits are tied exclusively to your individual account and cannot be transferred, gifted, sold, or shared under any circumstances.

6.6 — Taxes

You are solely responsible for all applicable federal, state, and local taxes related to your credit purchases. Propanalyzer does not collect or remit taxes on your behalf unless required by law.

Acceptable Use

You agree to use Propanalyzer solely for lawful purposes and in a manner fully consistent with these Terms. The following conduct is strictly prohibited:

Using the Platform to violate applicable laws or regulations

Submitting false, fabricated, or misleading property data or financial information

Attempting to reverse-engineer, decompile, or extract our AI models, algorithms, or source code

Using automated bots, scrapers, crawlers, or scripts

Creating multiple accounts for the same individual user

Sharing your account login credentials with any other person

Attempting to gain unauthorized access to other users' accounts or our systems

Engaging in real estate fraud, market manipulation, or deceptive practices

Interfering with the integrity, performance, or security of the Platform

Commercially reselling or sublicensing any part of the Platform or its outputs

Using the Platform in any way that could expose Propanalyzer to legal liability or reputational harm

7.2 — Consequences of Violations

Any violation may result in immediate suspension or permanent termination of your account, forfeiture of all unused credits without refund, a ban on future accounts, and — where conduct is illegal — referral to appropriate law enforcement authorities.

Intellectual Property

8.1 — Propanalyzer's Intellectual Property

The Propanalyzer platform — including its AI models, analysis algorithms, software code, database architecture, interface design, branding, logos, analysis methodologies, report templates, and all other platform content (excluding user-submitted data) — is owned by or licensed to Propanalyzer and protected by United States and international intellectual property laws.

These Terms do not transfer or grant you any ownership rights. You receive only a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform.

8.2 — Your Generated Reports

PDF analysis reports generated through your use are provided for your personal or professional real estate investment use. You may download, save, print, and share them. Reselling as a commercial data product requires our prior written consent.

8.3 — Feedback

If you submit suggestions, feedback, or ideas to Propanalyzer, you grant us a perpetual, irrevocable, royalty-free license to use, incorporate, and build upon that feedback without restriction or any obligation to compensate you.

Your Content & Data

By submitting property data, financial inputs, investment context, and other information to the Platform ("User Content"), you grant Propanalyzer a limited, non-exclusive, royalty-free license to use, process, store, and display that User Content solely for:

Processing your inputs to generate requested property analysis reports
Providing customer support related to your analyses
Improving and optimizing the Platform's AI, using only anonymized, non-identifiable, aggregate data

We do not claim ownership of your User Content. We will never sell, license, or disclose your individual property data or analysis inputs to third parties for commercial purposes.

You represent and warrant that: (a) you own or have the legal right to submit all User Content; (b) your User Content does not infringe on third-party rights; and (c) your User Content does not violate applicable laws or these Terms.

Termination & Suspension

10.1 — By You

You may close your account at any time through account settings. Deletion is permanent and irreversible. All unused credits are forfeited.

10.2 — By Propanalyzer

We reserve the right to suspend or terminate your account if you:

Violated any provision of these Terms
Engaged in fraudulent, deceptive, or abusive behavior
Provided materially false information
Engaged in conduct creating legal or reputational risk
Used the Platform for any unlawful purpose

10.3 — Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. Any unused credits are forfeited. Sections 5, 8, 11, 12, 13, and 14 survive termination.

Disclaimer of Warranties

⚠️ THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE"

To the fullest extent permitted by applicable law, Propanalyzer expressly disclaims all warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

Specifically, we do not warrant that:

The Platform will be uninterrupted, error-free, or available at all times
Any analysis output, financial calculation, or property valuation will be accurate or suitable for any particular purpose
Defects or errors will be identified or corrected on any specific timeline
Property data from third-party providers (ATTOM, Google Maps) is accurate, complete, or up to date
The Platform is free from viruses, malicious code, or other harmful components

You use the Platform and act upon its outputs entirely at your own risk.

Limitation of Liability

⚠️ TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Propanalyzer and its officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost investment returns, lost profits, loss of data, loss of goodwill, business interruption, or cost of substitute services — arising out of or related to your use of or inability to use the Platform.

In no event shall Propanalyzer's total aggregate liability to you for all claims exceed the greater of: (a) the total amount you paid in the 12 months preceding the claim, or (b) $50.00 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the fullest extent permitted by applicable law.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Propanalyzer and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of any provision of these Terms
Your use of the Platform or any reliance on its outputs
Any real estate transaction or investment decision based on Platform-generated analyses
Your submission of inaccurate, unlawful, or misleading property data or User Content
Your violation of any third-party rights, including intellectual property or privacy rights
Your violation of any applicable laws or regulations

Governing Law & Dispute Resolution

14.1 — Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Propanalyzer's incorporation, without regard to its conflict of law rules or principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.2 — Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact us in good faith at support@propanalyzer.com with a written description of the dispute and your desired resolution, and allow us at least 30 days to attempt to resolve the matter informally. Both parties agree to negotiate in good faith during this period.

14.3 — Binding Arbitration

If a dispute cannot be resolved informally, it shall be finally resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, conducted in English.

⚠️ Class Action Waiver

By agreeing to these Terms, you waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought in your individual capacity only.

14.4 — Exception for Equitable Relief

Notwithstanding the arbitration clause above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights, confidential information, or other proprietary rights.

Changes to These Terms

We reserve the right to update or modify these Terms at any time to reflect changes in our business, the Platform, or applicable law. When we make material changes, we will:

2Send an email notification to your registered account email address at least 14 days before the changes take effect
3Display a prominent in-platform notice for at least 14 days

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of and agreement to the changes. If you do not agree to the updated Terms, you must stop using the Platform. You may also delete your account, and any unused, refund-eligible credits will be refunded per Section 6.3.
